Terms of Service

These Terms of Service ("Terms") govern your engagement with Pure Coatings Epoxy ("Pure Coatings," "we," "us," or "our"), a flooring-installation business operating in the Greater Toronto Area, Ontario, Canada. By requesting a quote, signing a service agreement, or accepting any written or verbal quote from Pure Coatings, you ("Client," "you") agree to be bound by these Terms. If you do not agree, do not engage our services.

1. Services

Pure Coatings provides epoxy, polyaspartic, polished-concrete, and related concrete- coating installation services for residential and commercial properties in the GTA. The specific scope, materials, timeline, and price for each project are set out in a written Service Agreement or Quote issued by Pure Coatings. These Terms are incorporated by reference into every such agreement.

Pure Coatings reserves the right to decline any project at its sole discretion, including but not limited to projects where site conditions are deemed unsafe, structurally unsound, or incompatible with a coating system.

2. Quotes and Pricing

• All quotes are provided in Canadian dollars (CAD) and are valid for 30 days from the date of issue unless otherwise stated in writing.
• Quoted prices are based on information provided by the Client at the time of assessment. If on-site conditions differ materially from what was represented (e.g., undisclosed moisture, pre-existing coatings, hidden cracks, or square footage discrepancy greater than 10%), Pure Coatings may revise the quote before commencing work.
• Additional charges may apply for: crack repair beyond what was apparent at assessment, moisture mitigation, hazardous material abatement, access difficulties, or significant variations in surface condition discovered during preparation.
• Pure Coatings will not begin additional-scope work without written or email approval from the Client.

3. Payment Terms

• Deposit: A deposit of up to 50% of the total quoted price may be required to secure a booking date. Deposits are non-refundable if the Client cancels within 72 hours of the scheduled installation date.
• Balance: The remaining balance is due in full upon completion of the installation, prior to Pure Coatings vacating the premises.
• Accepted forms of payment: cash, e-Transfer, cheque, or credit card (processing fees may apply).
• Late payments: Balances unpaid more than 14 days after the completion date will accrue interest at 2% per month (24% per annum) until paid in full.
• Collections: The Client agrees to pay all reasonable legal fees and collection costs incurred by Pure Coatings to recover overdue amounts.

4. Client Responsibilities

The Client is responsible for:

• Removing all vehicles, furniture, stored items, shelving, and personal property from the work area before the scheduled installation date. A minimum clearance of 3 feet around all walls is required.
• Disclosing all known defects in the concrete substrate, including but not limited to: active water infiltration, previous coatings, oil contamination depth, radiant heat tubing, hydronic systems, and structural repairs.
• Ensuring safe and unobstructed access to the work area, including electrical power (110V) and running water within 50 feet of the installation area.
• Securing pets and ensuring no children are in the work area during installation and for 24 hours post-installation.
• Maintaining the recommended curing conditions (temperature above 10°C and below 30°C, no heavy traffic or moisture exposure) for the period specified by Pure Coatings after installation.

Failure to meet these responsibilities may result in additional charges, rescheduling fees, or warranty exclusions as set out in Section 6.

5. Cancellation and Rescheduling

• More than 72 hours' notice: No charge. Deposit is fully transferable to a rescheduled date.
• Between 24 and 72 hours' notice: A rescheduling fee of $150 applies. Deposit remains on account.
• Less than 24 hours' notice or no-show: Deposit is forfeited and a cancellation fee of up to 25% of the quoted price may be invoiced to cover mobilisation costs.
• Pure Coatings cancellation: If Pure Coatings cancels due to weather, equipment failure, or unforeseen circumstances, no fee applies and the deposit is fully refunded or transferred at the Client's election.

6. Warranty

6.1 Warranty Coverage

Pure Coatings provides a 7-year workmanship warranty on all installed coating systems, commencing on the date of installation. The warranty covers defects in materials supplied by Pure Coatings and defects in the application workmanship, including:

• Delamination or peeling of the coating system from the substrate.
• Bubbling or blistering not caused by post-installation moisture infiltration.
• Significant colour fading beyond normal UV exposure levels (polyaspartic topcoats only).

To make a warranty claim, the Client must contact Pure Coatings at hello@purecoatings.ca within the warranty period with photographs and a written description of the defect. Pure Coatings will conduct an on-site inspection within 14 business days and, if the claim is valid, will repair or recoat the affected area at no charge.

6.2 Warranty Voids — Events That Nullify the Warranty

• Moisture and water infiltration. Delamination, bubbling, or discolouration caused by groundwater, hydrostatic pressure, water seepage through cracks, plumbing leaks, flooding, snowmelt intrusion, or condensation from inadequate drainage is excluded. The Client is responsible for disclosing known moisture issues before installation; Pure Coatings' moisture test at the time of installation represents a point-in-time measurement only.
• Pre-existing or developing structural movement. Cracks, heaving, sinking, or surface separation resulting from soil settlement, frost heave, seismic activity, tree root intrusion, or concrete shrinkage that develops or propagates after installation voids the warranty in the affected area.
• Impact or mechanical damage. Chips, gouges, scratches, or delamination caused by dropped tools, heavy machinery, vehicle impacts, jack stands, floor jacks, metal-tipped equipment, or any impact exceeding the coating's rated impact resistance.
• Studded winter tires. Use of studded tires on a coated garage floor will scratch and abrade the coating surface. Damage from studded tires is excluded from warranty coverage.
• Chemical or thermal abuse. Exposure to caustic chemicals (drain cleaners, pool acid, industrial solvents, bleach concentrations above 10%), prolonged exposure to fuels beyond routine automotive drips, or sustained surface temperatures exceeding 120°C (e.g., live exhaust pipes resting directly on the surface).
• Failure to follow post-installation care instructions. Foot traffic before 24 hours post-installation, vehicle traffic before 72 hours post-installation, or heavy equipment placement before 7 days post-installation as specified in the written care instructions provided at project completion.
• Modification or repair by unauthorised parties. Any attempt to repair, patch, recoat, sand, grind, or chemically strip any portion of the installed system by the Client or any third party not authorised in writing by Pure Coatings.
• Salt and de-icer concentrations. Pooling of road salt brine or concentrated de-icing products (calcium chloride, magnesium chloride) on the surface for extended periods. Routine vehicle tracking of winter road salts is normal and covered; concentrated pools from leaking salt bags or direct application of de-icers are excluded.
• Client-supplied or Client-specified materials. If the Client supplied any materials incorporated into the installation, or directed Pure Coatings to use a specific product against our recommendation, defects attributable to those materials or that specification are excluded.
• Non-payment. The warranty is contingent on payment of all amounts due under the applicable Service Agreement. Outstanding balances suspend warranty obligations until paid in full.
• Acts of God and force majeure. Damage caused by fire, flood, earthquake, tornado, lightning strike, or other events beyond human control.

The warranty applies only to the original installation address and is non-transferable to subsequent property owners.

7. Limitation of Liability

To the maximum extent permitted by Ontario law:

• Pure Coatings' total aggregate liability to the Client for any claim arising from or related to the services — whether in contract, tort (including negligence), warranty, or otherwise — shall not exceed the total price paid by the Client for the specific installation giving rise to the claim.
• Pure Coatings shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of revenue, loss of use, loss of data, cost of substitute services, or loss of business opportunity, even if advised of the possibility of such damages.
• Pure Coatings shall not be liable for pre-existing defects in the concrete substrate that were not disclosed by the Client and were not reasonably detectable during the on-site assessment.
• Pure Coatings shall not be liable for damage to items left in the work area contrary to Section 4 above.

Nothing in these Terms limits or excludes any liability that cannot be excluded under Ontario's Consumer Protection Act, 2002 or other applicable mandatory law.

8. Intellectual Property

All content on the Site — including text, photographs, videos, graphics, and the Pure Coatings logo and brand — is owned by or licensed to Pure Coatings and is protected by Canadian copyright law. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

By submitting photographs of your project to us (e.g., during a warranty claim or for before/after documentation), you grant Pure Coatings a non-exclusive, royalty-free, perpetual licence to use those photographs in our marketing materials, website, and social media, provided that no personally identifying information about your property is disclosed without separate consent.

9. Site Use and Disclaimer

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Pricing, availability, and product specifications on the Site are subject to change without notice and do not constitute a binding offer. A binding agreement is only formed upon issuance of a signed Service Agreement or written Quote accepted by the Client.

Use of the Site is at your own risk. Pure Coatings does not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components.

10. Privacy

Your personal information is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

11. Dispute Resolution

11.1 Informal Resolution

Before initiating any legal proceedings, the Client must notify Pure Coatings in writing of the dispute and allow 30 days for good-faith resolution. Most disputes are resolved at this stage.

11.2 Mediation

If informal resolution fails, either party may refer the dispute to a mediator agreed upon by both parties. Costs of mediation are shared equally.

11.3 Courts

Disputes not resolved by mediation shall be submitted to the exclusive jurisdiction of the courts of the Province of Ontario, Canada. Claims not exceeding the Small Claims Court monetary limit may be brought in the Small Claims Court of Ontario.

12. Governing Law

These Terms and any Service Agreement are governed exclusively by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

13. Force Majeure

Pure Coatings shall not be in breach of any Service Agreement and shall not be liable for delays or failure to perform due to causes beyond its reasonable control, including but not limited to: acts of God, severe weather, pandemic, supply chain disruption, labour strikes, civil unrest, government orders, or utility failures. Pure Coatings will notify the Client promptly and reschedule as soon as reasonably practicable.

14. Severability and Entire Agreement

If any provision of these Terms is found invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force. These Terms, together with the applicable Service Agreement and Privacy Policy, constitute the entire agreement between the Client and Pure Coatings with respect to the subject matter hereof, and supersede all prior negotiations, representations, and understandings.

15. Amendments

Pure Coatings may update these Terms at any time by posting the revised version on the Site with a new effective date. The Terms in effect at the time a Service Agreement is signed govern that agreement. Continued use of the Site after a Terms update constitutes acceptance of the revised Terms.
